“After the whole ordeal of the Creategossip blog incident, I tried to pull out from Tumblr completely (remove themes and delete account). Between emails back and forth from one of Tumblr’s staff, my email’s purpose was completely ignored (Please remove my themes). No action taken.
That’s not the bad news - only the inconvenience. The real bad news is they can do whatever they want with my themes and account. I got bored and started reading, and according to Tumblr’s Terms of Service which I’m sure none of you have ever read, it states: “You hereby grant and agree to grant Tumblr an exclusive, perpetual, sublicensable, irrevocable, royalty-free right and license to use, copy, modify, and create derivative works of any Custom Theme contributed by You to the Site, including the code and media assets therefor.” (#4, Themes).
You agree that neither Tumblr nor the Site will be liable in any event to you or any other party for any suspension, modification, discontinuance or lack of availability of the Site, the service, your Subscriber Content or other Content. (#1, Access to the Services).
Tumblr retains the right to create limits on use and storage in its sole discretion at any time with or without notice. (#1, Access to the Services). In summary, Tumblr says: All your base are belong to us. They can do pretty much anything. Worst case scenario: someone complains about your blog and they delete your account and keep your themes.
So my girlfriend suggests I don’t delete my account and profit from this as much as I can. Dammit.”
